Cinevex Studio LLC ("Cinevex Studio," "we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), codified at 17 U.S.C. § 512, Cinevex Studio will respond expeditiously to claims of copyright infringement committed using our website and services located at cinevexstudio.com (the "Site").

2. Requirements for a Valid Takedown Notice
Pursuant to 17 U.S.C. § 512(c)(3), your Takedown Notice must include the following seven (7) elements:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs in the body of your notice is the best way to help us locate content quickly.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- The Takedown Notice must be sent to our DMCA Designated Agent at the contact information provided above.
3. Counter-Notification Procedure
If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us ("Counter-Notice") by submitting a written notification to our DMCA Designated Agent. Pursuant to 17 U.S.C. § 512(g)(3), your Counter-Notice must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which Cinevex Studio may be found), and that you will accept service of process from the person who provided the original Takedown Notice or an agent of such person.
If a valid Counter-Notice is received by our DMCA Designated Agent, we will send a copy of the Counter-Notice to the original complaining party informing them that we may restore the removed material or cease disabling it in 10 to 14 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be restored, or access to it restored, in 10 to 14 business days after receipt of the Counter-Notice, at our sole discretion.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Cinevex Studio has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. Cinevex Studio may also, at its sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Misrepresentation Warning
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney's fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider who is injured by such misrepresentation. We reserve the right to seek damages from any party that submits a Takedown Notice or Counter-Notice in violation of the law.
